By creating an account or using AuctionBuddha.com (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Service.

You must be at least 13 years old to create an account or use this website. By using this website or creating an account, you represent and warrant that you are at least 13 years old. The Service is not directed to children under 13, and we do not knowingly collect their information. You are responsible for complying with all laws that apply to you.

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your password confidential and for all activity under your account.
• Notify us promptly of any unauthorized use of your account.
• One person or business per account unless we agree otherwise.

You agree not to:

• Use the Service for any unlawful purpose or to sell prohibited or illegal items.
• Post false, misleading, infringing, or fraudulent content or listings.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or other users’ accounts.
• Harvest or misuse other users’ personal information, including buyer identities.
• Use the Service to harass, abuse, or harm others.

AuctionBuddha.com is a venue that connects buyers with independent vendors and lets them list, sell, and bid on items. Vendors — not AuctionBuddha.com — are responsible for the accuracy of their listings and for the items they sell. We are not a party to the sale between a buyer and a vendor, although we may help facilitate or mediate transactions. Antiques, estate jewelry, and collectibles are generally sold on an “as-is” basis; please review item descriptions and condition notes carefully.

We do not charge cards on the website. Orders are completed by invoice — the seller or AuctionBuddha.com sends payment instructions, and you pay according to those instructions. Prices are in U.S. dollars, and any applicable sales tax, where required, is added to your invoice. Title and risk pass as described on the invoice and in our Shipping and Returns & Refunds policies.

Bids placed in our auctions are binding offers to buy. If you win, you are obligated to complete the purchase. Auction activity is also governed by our Auction Terms, which are part of these Terms.

Selling on AuctionBuddha.com requires an approved vendor account and is governed by our Vendor Terms, which are part of these Terms.

The Service, including its design, text, and software, is owned by AuctionBuddha.com or its licensors and is protected by law. Vendors retain ownership of the listing content and images they upload and grant us a license to display and promote that content on the Service. You may not copy, scrape, or reuse site content without permission.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that any item description is complete or accurate.

To the fullest extent permitted by law, AuctionBuddha.com will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three months before the claim or $100.

You agree to indemnify and hold harmless AuctionBuddha.com and its operators from claims, losses, and expenses arising from your use of the Service, your content or listings, or your violation of these Terms.

You may close your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or for any lawful reason. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. If a dispute arises, you agree to first contact us and try to resolve it informally. If we cannot resolve it within a reasonable time, the dispute will be brought exclusively in the state or federal courts located in Collier County, Florida, and you consent to their jurisdiction.

We may update these Terms from time to time. When we make material changes, we will update the effective date and version above. Continued use of the Service after a change means you accept the updated Terms.
